Implementation of background checks
The last newsletter contained some information on the new procedure regarding background checks. In the meantime, the federal states have taken a stand on the
have taken a position on the issue. This results in the following situation:
For the purpose of a background check in accordance with § 7 of the Aviation Security Act
(LuftSiG), the data in the sense of 11.1.3(c) of the Implementing Regulation (EU) 2015/1998 (verification of gaps in periods of employment, training and other gaps during at least the last five years) can be completely collected and assessed by the and assessed by the companies in order to improve the processing speed of the corresponding applications to the aviation security authorities for persons employed or to be employed by the respective company. According to this procedure, the companies can collect the required data, possibly conduct and document interviews as a substitute for documents, and evaluate the information thus collected as plausible. The companies send the notification of the evaluation to the aviation security authority together with the respective documents. The aviation security authority checks the documents on a random basis. This requires that the companies participating in this procedure have obtained the prior consent of the persons to be checked. Ultimately, this also leaves it up to each person to be checked to decide whether the application should be made via the participation procedure or according to the previous normal procedure. I would like to point out that each person to be reviewed has the fundamental right to participate in the normal procedure, even if the company in principle participates in the participation procedure. No disadvantage may result from this decision for a person concerned.
For non-existent receipts for periods of at least 28 days, an Interview Verification may be made as a special voucher substitute. This interview is
documented in a uniform manner throughout Germany. A corresponding form has been developed for this purpose. The interview should be conducted by a company safety officer and also serves to check the plausibility of the information provided by the interviewer.
by the interviewer. Further explanations are contained in the form’s accompanying
instructions for completing the form.
The aviation security authorities must ensure a quality check of at least 2% as part of the participation procedure. For this purpose, the BMI recommends that the aviation security authorities oblige the companies to send all employment verifications and, if applicable, completed voucher replacement forms completely and directly with the application for each case in the participation procedure. This requires that the companies have obtained the consent of the applicant to the data processing.
In particular, it should be noted that if the participation procedure is carried out consistently in accordance with the available guidance, no liability problems will arise for the companies or the security officers conducting the interviews.
The companies are obligated to report to the aviation security authorities the fulfillment or non-fulfillment of the task. or non-fulfillment of the task in the sense of the participation procedure in each individual case. For this purpose, the respective applications for an aviation security the fields to be filled in by the companies should be added to the respective applications for a to be completed by the companies. If the alternative “No data (…) was collected” is selected, the application does not take part in the application does not take part in the participation procedure, so that the evidence must be sent by the applicant himself and checked by the aviation security authority (current normal procedure).
The implementation of this participation procedure is the responsibility of the federal states. At present, it is only known that BW and HH have already begun to accept corresponding applications. applications. Information on this can be found at

and https://www.hamburg.de/bwi/luftsicherheit/16970626/luftsicherheit-berufspilotenbeteiligungsverfahren/.
Details on the question of when exactly a country will start offering the procedure would currently still have to be requested directly from the aviation security authorities.
The federal states of Rhineland-Palatinate, Saxony, Saxony-Anhalt and Thuringia have spoken out against have spoken out against the introduction of the procedure.
In addition, efforts are currently underway to handle this procedure in an online service. It is not yet clear when this will be the case.
The new participation procedure is likely to raise one or two questions. In order not to
In order not to deal with this individually and, if necessary, to ensure an exchange among each other, the VDF management is offering an online meeting. This will take place on Monday, 17 April 2023, 1.30 pm. If you are interested, please register by providing the name(s) of the participants and the corresponding e-mail address to gf@vdf-ev.com.
Development at German commercial airports in February 2023
The monthly statistics for February 2023 from the German Airports Association (ADV) show that the recovery in passenger
in German passenger traffic is still below the European average. Across Europe, air traffic demand has already recovered to 89%, in Germany this is only 67.9%.
Demand in domestic air traffic remains at a low level. With 1.47 million
passengers (+82.4% vs. 2022), the domestic German market is the only traffic segment
segment that was able to increase compared to the previous month of January (approx. +50,000). However, the pre-crisis level is still
more than half of all passengers (-57.6%).
In European traffic, the recovery in traffic demand compared with the previous year
continued at a slower pace. 6.83 million passengers represent a +56.9% growth to February 2022, from the pre-crisis level of 2019, just under three quarters of air traffic demand (-26.5%).
Intercontinental demand can almost double from the same month last year with +96.8% to over 2.33 million passengers. Compared to January 2019, this is 80.0% of passengers. The intercontinental segment thus has the highest recovery rate among the traffic segments.
